Murder Charge Dropped Against Paul Younan in Omega Ruston Cold Case

Prosecutors have dropped the murder charge against Paul Younan, the final remaining suspect charged over the 2009 shooting death of Gold Coast father Omega Ruston.

The decision was announced in the Brisbane Magistrates Court on Monday, September 21, with the prosecution stating that it would offer no evidence on the murder charge.

Murder Charge Discontinued
Ruston, 32, was shot twice beside the Gold Coast Highway at Burleigh Heads in January 2009. Police previously alleged the shooting followed a road-rage incident involving two vehicles.

Younan, a former member of the Nomads Outlaw Motorcycle Club, was among four men charged in connection with the cold-case investigation in 2022.

The murder charge against Younan has now been discontinued.

Cold Case Investigation
The homicide remained unsolved for more than a decade before Queensland police reopened the investigation.

In 2020, the Homicide Cold Case Investigation Team and Gold Coast Criminal Investigation Branch conducted a major review. Police later announced forensic developments involving DNA, fingerprint and ballistic evidence and offered a $250,000 reward for information leading to a conviction.

Younan was arrested in New South Wales in 2022 and subsequently faced the murder allegation.

27 Perjury Charges Remain
Although the murder charge has been dropped, Younan still faces 27 charges of perjury connected to the case.

Those charges are scheduled to be heard in the Brisbane Magistrates Court on October 12, 2026.

Other charges connected with Ruston’s death have also previously been discontinued, leaving the 2009 killing without a current murder prosecution.

Family Says It Is Devastated
Ruston’s family told ABC News they were deeply disappointed by the decision.

His brothers said the family had hoped the case would eventually reach trial and provide answers about who was responsible for his death. They also said they feared they may never receive closure.

The discontinuation of the charge does not establish Younan’s innocence or guilt regarding the 2009 killing; it means prosecutors are no longer proceeding with that murder charge.
