A 47-year-old Texas man has been arrested and charged with capital murder after a shooting on a Harris County roadway killed a 5-year-old girl and injured two of her siblings.

Jeremy Porter was taken into custody on Sunday, Sept. 20, less than 24 hours after the shooting that claimed the life of Zah’Layah Walter, according to the Harris County Sheriff’s Office. He was booked into the Harris County Jail and remained in custody as the investigation continued.

The shooting happened late Saturday night, Sept. 19, in the Cypress area of northwest Harris County. Authorities said a vehicle carrying Zah’Layah, her mother Monica Hicks, and her four siblings was traveling westbound on Grant Road near Jones Road shortly after 11:30 p.m. when gunfire struck the vehicle.

According to investigators and court records, a white Ford pickup truck was seen leaving the area after shots were fired. Zah’Layah was struck by a bullet and was later transported by Life Flight helicopter to a hospital, where she was pronounced dead.

Two of her siblings also suffered injuries from shattered glass. Their injuries were described by authorities as non-life-threatening. Hicks was not physically injured.

Mother Says There Was No Confrontation

The incident was initially described by authorities as a possible road-rage shooting. However, Hicks has disputed that characterization, saying there was no argument, confrontation, horn exchange or other interaction with another driver before the gunfire.

Hicks told local television stations that she was returning home with her children after visiting her mother. She said she heard the vehicle’s window break and realized something was seriously wrong only after reaching her apartment complex.

According to court documents cited by the Houston Chronicle, Hicks called 911 after discovering that Zah’Layah had been shot. She reportedly saw that her daughter had suffered a gunshot wound to the head and attempted to provide aid while waiting for emergency responders.

The child’s death has left her family and siblings facing the aftermath of a sudden and violent loss. Hicks described Zah’Layah as the “light of my life” in interviews with local media.

Investigators Used License Plate-Reader Technology

Authorities said automated license plate reader technology played an important role in identifying the vehicle believed to be involved.

According to court records, investigators used Flock Safety cameras to track the white Ford pickup truck to a residence. Officers subsequently located Porter and questioned him about the shooting.

Court records cited by the Houston Chronicle state that Porter acknowledged being the driver and told investigators that he had fired five rounds at the other vehicle. Investigators reportedly found four bullet defects in the family’s vehicle.

The records also indicate that Porter believed the other vehicle had fired at him and that he believed its driver was a man traveling with several occupants. Hicks, however, has said that she never interacted with the other driver and did not cut anyone off or engage in any confrontation.

Harris County Sheriff Ed Gonzalez credited the automated license plate reader system with helping detectives quickly develop information that led to the arrest.

Capital Murder Charge

Porter has been charged with capital murder in connection with Zah’Layah’s death. His arrest does not establish guilt, and he remains legally presumed innocent unless and until he is convicted in court.

According to Harris County court records reported by the Houston Chronicle, Porter appeared for a probable-cause hearing and was scheduled for another court appearance in the 338th District Court. Prosecutors had also filed a motion seeking to deny bail, although a bail hearing had not yet been scheduled at the time of the report.

The investigation remains active, and authorities have indicated that additional details may emerge as detectives continue examining the circumstances surrounding the shooting.

The case has drawn significant attention in the Cypress and northwest Harris County communities, particularly because the shooting occurred while a mother was driving with all five of her young children in the vehicle.

For Zah’Layah’s family, the investigation follows the devastating loss of a young child whose life ended during what should have been an ordinary trip home.
