A heartbreaking Virginia case is drawing renewed attention after newly public surveillance details and upgraded charges revealed more about what allegedly happened inside a Norfolk Walmart before 77-year-old Bert Atienza lost consciousness.

Bert and his wife, Josephine, had reportedly stopped at the store after church on June 7 when a 17-year-old Walmart employee allegedly came close to striking Josephine with a shopping cart. Bert confronted the teen over the incident, and witnesses say an argument followed. The teen then allegedly threw a can toward the couple before contacting her parents.

Prosecutors say the situation escalated when the teen’s parents, Travis White, 44, and Erika Mitchell, 42, arrived at the store. Surveillance footage reportedly shows the pair confronting Bert and then shoving, punching and kicking him after he fell to the floor. Josephine told reporters she begged them to stop and warned that her husband had a heart condition.

One of the most painful new details comes from Josephine’s account of Bert’s final conscious moments. She said he was still able to speak after the attack and asked for help getting up. Moments later, she realized he was no longer responsive. Bert was taken to a hospital and died the following day from blunt-force head trauma; his death was ruled a homicide.

White and Mitchell were initially charged with offenses including malicious wounding, but after Bert’s death, the charges were upgraded to second-degree murder. Both adults are being held without bond. Their attorney has argued that the confrontation was spontaneous and emotionally driven rather than planned, an issue that will ultimately be tested in court.

The teenage employee is also facing serious juvenile charges, including aggravated malicious wounding and conspiracy allegations, and is being held in juvenile detention. Walmart has said she is no longer employed by the company and that it is cooperating with investigators.

The surveillance footage may now become one of the most important pieces of evidence in the case, because it could help jurors determine how the confrontation began, how long the alleged assault lasted, and whether the defendants’ actions support the upgraded murder charges.
