Janette MacAusland Case Delayed as Lawyer Seeks Dismissal After Children’s Deaths

A Massachusetts mother accused of killing her two young children remains behind bars without bail after a judge rejected her attorney’s request to dismiss the case or release her while prosecutors await additional information from the medical examiner.

Janette MacAusland, 49, of Wellesley, Massachusetts, is charged with two counts of first-degree murder in connection with the deaths of her children, Kai, 7, and Ella, 6. The children were found dead inside their Wellesley home on April 24, 2026.

At a probable-cause hearing on September 10, defense attorney Joseph Krowski Jr. asked the court to dismiss the case, arguing that prosecutors had not yet received the formal cause-and-manner-of-death determination from the Office of the Chief Medical Examiner.

The judge denied the dismissal request. MacAusland also remains held without bail as the case continues through the Massachusetts court system.

Krowski also raised the recent Lindsay Clancy case during arguments and discussions with reporters. Clancy’s trial ended in a mistrial after jurors failed to reach a unanimous verdict, bringing renewed attention to questions surrounding mental illness and criminal responsibility.

Krowski emphasized that MacAusland’s case is different, telling reporters, “This is not Lindsay Clancy 2.0.” He said, however, that the Clancy proceedings had contributed to a broader public discussion about how the criminal justice system handles defendants with serious mental-health issues.

The attorney has not confirmed whether MacAusland will ultimately pursue a defense based on a lack of criminal responsibility. Krowski said he was not prepared to discuss potential defenses until he had received more information, adding that “everything is on the table.”

The case has also been delayed while authorities await the medical examiner’s findings. Prosecutors have requested additional time to develop the case, and a grand jury investigation remains ongoing.

MacAusland was arrested in Vermont after authorities were alerted to concerns about the children. According to investigators, she had gone to her aunt’s home in southern Vermont after the deaths and allegedly said that she had killed the children. She was also found with a serious injury to her throat after an apparent suicide attempt, according to authorities.

At the time of the children’s deaths, MacAusland was involved in a contentious divorce and custody dispute with their father. Court records show the couple had been working through custody arrangements before the tragedy.

MacAusland’s next court appearance is scheduled for October 29, 2026. For now, she remains in custody, no dismissal or release has been granted, and the criminal case remains unresolved.

The allegations against MacAusland have not been proven in court, and she is presumed innocent unless and until proven guilty.
