The Lindsay Clancy case has taken another major turn as her defense challenges the mistrial itself and asks the court to investigate the lone juror who refused to join the other 11 panel members.

On September 22, Clancy’s attorneys filed a motion seeking dismissal of the murder charges on double-jeopardy grounds, arguing that the September 4 mistrial should not have been declared without first examining whether the holdout juror could have been removed and replaced. The defense is also asking Judge William Sullivan to scrutinize that juror’s conduct and truthfulness during jury selection. ABC7 New York

One allegation now drawing particular attention concerns possible cellphone use during deliberations. Clancy’s lawyer Kevin Reddington has asked the court to examine whether juror Michael Desronvil accessed his phone while the jury was secluded and debating the case. Other jurors have reportedly raised similar concerns, although Desronvil and his attorney deny misconduct. AP News

The issue is potentially significant because the jury reportedly stood 11–1 in favor of finding Clancy not criminally responsible due to her mental condition. Desronvil was the only juror favoring conviction, and after roughly a week of deliberations the judge declared a mistrial when the panel said it could not reach unanimity. CBS News

Clancy’s original trial centered on whether she was criminally responsible when she killed her children, Cora, Dawson and Callan, in January 2023. Her defense argued that she was suffering from postpartum psychosis, while prosecutors maintained that the evidence showed she understood her actions. The defense is now pursuing more than one route. In addition to the juror investigation and double-jeopardy argument, Reddington has asked the judge to enter a required finding of not guilty rather than send the case to another jury. No ruling has yet been issued on those requests. WHDH 7News

Patrick Clancy’s recent 60 Minutes interview has also renewed public attention on the case. He spoke about his grief, his forgiveness of Lindsay and his belief that severe mental illness played a central role in the tragedy, while condemning online conspiracy theories surrounding the family.
